Purposes, legitimate interest and legal basis of data processing
Data processing is carried out on the basis of Section 4 BDSG (German Federal Data Protection Act) and Art. 6(1)(f) GDPR for the following purposes and interests:
- Exercise of domiciliary rights
- Protection of property
- Prevention and investigation of criminal offences (in particular theft and vandalism)
- Contractual liability towards customers
Storage period or criteria for determining the duration
In the case of recording, the data is stored for a maximum of 72 hours. A longer storage period only applies if this is necessary to enforce legal claims or to prosecute criminal offences in individual cases.
Recipients or categories of recipients of the data
Recorded data is only transferred to third parties (e.g. the police) if this is necessary for the investigation of criminal offences.
Information on the rights of data subjects
The data subject has the right to obtain confirmation from the controller as to whether personal data concerning them is being processed; if this is the case, they have a right of access to this personal data and to the information set out in detail in Art. 15 GDPR.
The data subject has the right to request from the controller the immediate rectification of inaccurate personal data concerning them and, where applicable, the completion of incomplete personal data (Art. 16 GDPR).
The data subject has the right to request from the controller the erasure of personal data concerning them without undue delay, provided that one of the reasons set out in detail in Art. 17 GDPR applies, e.g. if the data is no longer necessary for the purposes pursued (right to erasure).
The data subject has the right to request from the controller the restriction of processing if one of the conditions set out in Art. 18 GDPR applies, e.g. if the data subject has objected to the processing, for the duration of the review by the controller.
The data subject has the right to object at any time, on grounds relating to their particular situation, to the processing of personal data concerning them. The controller shall then no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or the processing serves the establishment, exercise or defence of legal claims (Art. 21 GDPR).
Every data subject shall have the right to lodge a complaint with a supervisory authority, without prejudice to any other administrative or judicial remedy, if the data subject considers that the processing of personal data concerning them infringes the GDPR (Art. 77 GDPR). The data subject may exercise this right with a supervisory authority in the Member State of their habitual residence, their place of work or the place of the alleged infringement.
